          New Delhi, dated the 14th October, 2004. 

NOTIFICATION

S.O 1120 (E).        In exercise of the powers conferred under sub-section (1) of section 25 of the Khadi and Village Industries Commission Act, 1956 (61 of 1956), hereinafter referred to as the said Act, the Central Government hereby dissolves the Khadi and Village Industries Commission established under sub-section (1) of section 4 of the said Act with effect from 14th October, 2004.

2.       Consequent upon dissolution of the said Commission and in pursuance of the provisions of sub-section (2) of section 25 of the said Act,-

  1. (a)               all properties and funds which, immediately before the said date of dissolution were in the possession of the Khadi and Village Industries Commission shall now vest in the Central Government; and
  2. (b)              all members including Chairman of the Khadi and Village Industries Commission shall vacate their respective offices.

          New Delhi, dated the 14th  October, 2004.

ORDER

S.O 1121 (E)         Whereas upon dissolution of the Khadi and Village Industries Commission vide notification No 1120(E) dated the 14th October, 2004, the Central Government has established an authority in the name and style of “Commissioner for Khadi and Village Industries” vide Resolution of the Central Government under clause (i) of Article 73 of the Constitution of India, published in the Gazette of India, Extraordinary, Part I, Section 1 dated the 14th October, 2004, number 239; the Central Government therefore makes an order that Smt. Maya S. Sinha, Financial Adviser and Chief Executive Officer (In-charge) of the said Commission shall discharge the functions of the Commissioner for Khadi and Village Industries, Mumbai, till further orders in addition to the current charge being handled by the said officer. 

          This issues with the approval of Minister for Small Scale Industries and Agro and Rural Industries.

RESOLUTION

No 239.      WHEREAS the Government of India in exercise of the powers conferred under sub-section(1) of section 25 of the Khadi and Village Industries Commission Act, 1956 (61 of 1956) has dissolved the Khadi and Village Industries Commission (KVIC), hereinafter referred to as “Commission”, vide notification S.O. No 1120 (E) dated the 14th October, 2004, with effect from the 14th October, 2004;


          AND WHEREAS in accordance with the powers conferred under clause (a) of sub-section (2) of section 25 of the said Act on and from the said date of the 14th October, 2004, all properties and funds which, immediately before the said date, were in the possession of the Commission for the purposes of the said Act have been vested in the Central Government;


          AND WHEREAS all members including Chairman have vacated their office as members or Chairman of the Commission on dissolution of the Commission;

AND WHEREAS all properties and funds of the erstwhile Commission which have now got vested in the Central Government after the dissolution of the Commission are required to be administered by the Central Government through its designated authority;

AND WHEREAS, it has become necessary to continue all existing policies, programmes, schemes and all other related activities on the same terms and conditions as were being implemented by the erstwhile Commission immediately before its dissolution;

 NOW, THEREFORE, in exercise of the powers conferred under Article 73 of the Constitution of India, the Central Government hereby resolves that an authority in the name of the Commissioner for Khadi and Village Industries be established who shall henceforth look after all the properties and funds of the said Commission, which were in its possession at the time of its dissolution and exercise all powers and perform functions of the Khadi and Village Industries Commission, which were hitherto being performed by the said Commission, under various provisions of Khadi and Village Industries Act, 1956 (61 of 1956), Khadi and Village Industries Commission Rules, 1957 and regulations made thereunder.

2.       The Central Government also resolves that the Commissioner for Khadi and Village Industries shall be responsible for the proper functioning of the organization and shall perform the following functions, namely :-

(i)   to exercise administrative control over all departments and officers of the organization;

(ii)   to plan, promote, organize and assist in the establishment and development of khadi and village industries in coordination with other agencies engaged in rural development wherever necessary;

(iii)   to plan and organize training of persons employed or desirous of seeking employment in khadi and village industries;

(iv)   to build up reserves of raw materials and implements and supply them to persons engaged or likely to be engaged in production of handspun yarn or khadi or village industries at such rates as may be decided;

(v)   to encourage and assist in the creation of common service facilities for the processing of raw materials or semi-finished goods and for otherwise facilitating production and marketing of khadi or products of village industries;

(vi)   to promote the sale and marketing of khadi, and products of village industries;

(vii)   to encourage and promote research in the technology used in khadi and village industries, including the use of non-conventional energy and electric power with a view to increasing productivity, eliminating drudgery and otherwise enhancing their competitive capacity and to arrange for dissemination of salient results obtained from such research;

(viii)   to undertake directly or through other agencies studies of the problems of khadi or village industries;

(ix)   to provide financial assistance to institutions or persons engaged in the development and operation of khadi or village industries and guide them through supply of designs, prototypes and other technical information for the purpose of producing goods and services;

(x)   to undertake experiments or pilot projects which may be necessary for the development of khadi and village industries;

(xi)   to maintain separate organizations for the purpose of carrying out any or all of the above matters;

(xii)   to ensure genuineness and to set up standards of quality so that products of khadi and village industries conform to the said standards, including issue of certificates or letters of recognition to the concerned persons;

(xiii)   to implement the various schemes of the Central Government like the Rural Employment Generation Programme (REGP), Rebate Scheme, etc. being implemented by the erstwhile Commission;

(xiv)   to prepare and submit budget by such date in each year to the Central Government for approval as may be prescribed;

(xv)   To maintain or cause to be maintained an account of the receipt and expenditure of the organization;

(xvi)   to enter into contracts, himself or through any officer authorised by him in connection with its trading and other activities provided provision therefor exists in the sanctioned budget;

(xvii)   to grant loans in accordance with the provisions of the loan rules for khadi and village Industries made by the Government from time to time, and in accordance with and at rates and on terms sanctioned by the Government in respect of each industry from time to time;

(xviii)   to borrow, with the previous sanction of the Central Government, on the security of the khadi fund, village industries fund or any other assets for any purposes for which such funds may be applied;

(xix)   to write off losses with the prior consultation with the Financial Adviser, upto Rs. 10,000 falling under any or all of the following categories:-

(a)   loss or irrecoverable value of stores or of public money due to theft, fraud etc.;

(b)   loss or irrecoverable advance other than loans; and

(c)   deficiency and depreciation in the value of stores.

(xx)   to take suitable action against the persons responsible for the loss and shall also send to the Government a detailed report together with the action taken against the persons, if any, responsible for the loss;

(xxi)   to recover sum payable to the Commissioner for Khadi and Village Industries under any agreement, expressed or implied, or otherwise howsoever, in the manner as an arrear of land-revenue;

(xxii)   to implement any other scheme or perform such other functions which may be assigned to him by the Central Government;

(xxiii)   to undertake such other duties and exercise such other powers as may be assigned to him by the Central Government;

(xxiv)   to issue directions as to the method of carrying  out the decisions of the Central Government; and

(xxv)   to carry out any other functions incidental to the above.

3.       The Central Government also resolves that the Chief Executive Officer, the Financial Adviser and all other employees of the erstwhile Commission, including those in the trading cadre shall continue to hold office and shall enjoy the same status in regard to service matters as they were doing at the time of dissolution of the Commission and shall henceforth function under the overall supervision and control of the Commissioner for Khadi and Village Industries.

4.       The Central Government further resolves that the Commissioner for Khadi and Village Industries may appoint such other officers and staff, as it considers necessary for its efficient functioning with the prior approval of the Central Government.  The Commissioner for Khadi and Village Industries shall also exercise all powers in the matters of promotion, loans and advances, leave, conduct of its officers and staff as per the existing rules applicable to Khadi and Village Industries Commission Employees on the date of dissolution of the said Commission.

5.        The Central Government further resolves that all liabilities incurred by, all contracts entered into with and all matters and things engaged to be done by or for the Khadi and Village Industries Commission in connection with the development of khadi or village industries at any time before the commencement of this Resolution, shall, after such commencement, be deemed to have been incurred by, entered into with, or engaged to be done by, or for, the Commissioner for Khadi and Village Industries.

 

6.       The Central Government may, after due appropriation made by Parliament by law in this behalf, pay to the Commissioner for Khadi and Village Industries in each financial year such sums as may be considered necessary for performing the aforesaid functions.

 

7.       The Central Government further resolves that -

(i)      The Commissioner for Khadi and Village Industries may for the purpose of development of khadi, the development of village industries or the development of khadi and village industries, receive gifts, grants, donations, or benefactions from the Government or any other person;

(ii)      The Commissioner for Khadi and Village Industries shall continue to have three separate funds called the khadi fund, village industries fund and the general and miscellaneous fund and all sums received by the Commissioner for Khadi and Village Industries shall be credited to these funds and shall also be applied for the purposes in the same manner as was being done immediately before the dissolution of the said Commission;

(iii)      The Commissioner for Khadi and Village Industries may reconstitute the existing Committee(s) and sub-committee(s) and may constitute any new Committee(s) and sub-committee(s), as considered necessary, for performing any of the aforesaid functions, with the prior approval of the Central Government;

(iv)      The headquarters of the Commissioner for Khadi and Village Industries shall be at Mumbai or at such other place as the Central Government may from time to time direct;

(v)      The Commissioner for Khadi and Village Industries, if for any reason is unable to attend his office, any officer as may be specifically authorized by the Central Government shall discharge the duties and functions of the Commissioner for Khadi and Village Industries;

(vi)      Without prejudice to the above, in discharge of its powers and functions under this Resolution, the Commissioner for Khadi and Village Industries shall be bound by such advice and directions as the Central Government may give to it from time to time.
